Hosted-Tech Terms of Service

Welcome to Hosted-Tech (“Hosted-Tech,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of all services we provide, including but not limited to dedicated servers, virtual private servers (VPS), cloud servers, managed hosting, unmanaged hosting, game servers, PBX/VoIP solutions, cloud storage, DNS and domain services, website hosting, WordPress management, IT support, and on-site/remote technical services (collectively, the “Services”). By using our Services, you agree to these Terms.

1. Eligibility

To use our Services, you must:

  • Be at least 18 years old.
  • Provide accurate registration and billing information.
  • Agree not to use the Services for illegal or abusive purposes.

We may refuse service at our sole discretion.

2. Services Provided

Hosted-Tech provides a wide range of technology services, including but not limited to the following categories:

2.1 Infrastructure Services

  • Dedicated Servers
  • Virtual Private Servers (VPS) & Cloud Servers
  • Managed & Unmanaged Hosting
  • Cloud Storage & Backups
  • DNS and Domain Management

2.2 Communications Services

  • Hosted PBX & VoIP
  • SIP Trunking
  • IVR & Custom Call Routing
  • Local, Toll-Free, & Vanity Phone Numbers

2.3 Application & Website Services

  • Website Hosting & Management
  • WordPress Installation, Support, and Optimization
  • Email Hosting (where offered)

2.4 Support Services

  • Remote Support (typically 30–60 minute response during business hours unless otherwise agreed)
  • On-Site Support (nationwide dispatch via third-party contractors where available)
  • Managed IT Services & Consulting

2.5 Specialty Hosting & Custom Solutions

  • Game Server Hosting
  • Custom Private Phone Systems
  • Custom Cloud Solutions and Infrastructure Design

All Services are provided on an “as-is” and “as-available” basis, and availability may vary based on region, network conditions, and third-party providers.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity occurring under your account.
  • Ensuring your contact and billing information remains accurate and current.
  • Securing any data, content, or software hosted on our systems.
  • Maintaining backups of your data unless you have purchased a managed backup plan.

You must notify us immediately if you suspect unauthorized access to your account or Services.

4. Acceptable Use Policy (AUP)

You agree not to use the Services for any unlawful, abusive, or disruptive purpose. Prohibited activities include, but are not limited to:

  • Engaging in or facilitating illegal activities of any kind.
  • Sending spam, phishing messages, or unsolicited bulk communications.
  • Hosting malware, viruses, or any malicious or harmful software.
  • Storing, sharing, or distributing copyrighted content without appropriate rights or permission.
  • Running open proxies, unauthorized crypto-mining (unless explicitly permitted), or resource-abusive workloads.
  • VoIP fraud, robocalling, mass-dialing, war-dialing, or illegal telemarketing practices.
  • Launching, facilitating, or participating in DDoS attacks or any network abuse.
  • Any activity that degrades, interferes with, or disrupts the performance of the Services for other customers.

Violation of this Acceptable Use Policy may result in suspension or termination of your Services without refund.

5. Payment, Billing & Renewals

5.1 Billing

Services are typically billed in advance on a monthly basis unless otherwise specified in your order or agreement. Invoices must be paid by the stated due date.

5.2 Automatic Renewal

Most Services renew automatically at the end of each billing period unless you cancel the Service in accordance with these Terms. By enabling automatic renewal, you authorize us to charge your payment method on file for subsequent periods.

5.3 Late Payments

Accounts that are more than 5 days past due may be suspended until payment is received. Accounts that are more than 15 days past due may be terminated and data may be permanently deleted.

5.4 Pricing Changes

We may update our pricing from time to time. Except where prohibited by law or a separate written agreement applies, we will provide at least 30 days’ notice of recurring price changes.

6. Cancellations & Refunds

6.1 Cancellations

You may cancel Services at any time through the account portal (where provided) or by contacting our support team. Cancellations must be received before the next billing date to avoid additional charges.

6.2 Refunds

Refunds are not guaranteed and are issued only at our sole discretion unless otherwise required by law or a written agreement. The following items are generally non-refundable:

  • Dedicated servers
  • VPS and Cloud servers
  • PBX/VoIP services
  • Custom development, engineering, or consulting work
  • Domain registrations, renewals, or transfers
  • On-site support services
  • Setup and installation fees

Prorated or partial refunds are not typically provided unless explicitly stated in your service agreement.

7. Service Level & Uptime

We strive to provide reliable Services with high availability. However, we do not guarantee 100% uptime. Service interruptions may occur due to maintenance, hardware failure, network issues, power events, upstream provider outages, or other circumstances beyond our reasonable control.

Where a specific Service Level Agreement (SLA) is provided for a particular service, such SLA terms will govern in the event of any conflict with this section.

8. Data, Backups & Security

You are solely responsible for the integrity of your data and for maintaining appropriate backups, unless you have purchased a managed backup service from us. Managed backup services, where offered, are subject to their own terms and limitations.

  • You are responsible for securing your accounts and passwords.
  • You are responsible for updating and maintaining software installed on unmanaged services.
  • You are responsible for ensuring compliance with regulatory requirements (such as HIPAA, PCI, etc.) applicable to your data and use case.

We follow industry-standard security practices but cannot guarantee absolute security. No method of transmission or storage is completely secure.

9. Support & Maintenance

9.1 Remote Support

Remote support may be provided via ticket system, email, chat, or remote desktop tools. Response times may vary depending on service level, time of day, and current support volume.

9.2 On-Site Support

On-site support is offered where available and may be provided by Hosted-Tech technicians or third-party contractors. Additional fees, minimums, or travel costs may apply.

9.3 Managed vs. Unmanaged Services

Managed Services: We assist with configuration, maintenance, monitoring, and general system health according to the scope defined in your plan.

Unmanaged Services: You are responsible for installing, configuring, securing, and maintaining the software and services hosted on your server. Our responsibility is generally limited to hardware and network availability.

9.4 Maintenance Windows

We may perform planned maintenance from time to time, which may result in temporary service interruptions. When practical, we will schedule maintenance during off-peak hours and may provide notice in advance, but we reserve the right to perform emergency maintenance without prior notice.

10. Software Licensing

You are responsible for obtaining and maintaining proper licenses for any software you install, upload, or request us to install on your behalf. You agree not to use unlicensed or pirated software on our infrastructure. Hosted-Tech is not responsible for your software license compliance.

11. Termination

We may suspend or terminate your account and/or Services, with or without notice, if:

  • You violate these Terms or our Acceptable Use Policy.
  • Your account becomes seriously past due.
  • You engage in unlawful, abusive, threatening, or harmful behavior.
  • Your use of the Services creates risk or harm to our systems, reputation, or other customers.

Upon termination, your access to the Services will cease, and we may permanently delete your data. We have no obligation to maintain or provide a copy of your data after termination.

12. Limitation of Liability

To the fullest extent permitted by law, Hosted-Tech and its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Services.

Our total aggregate liability for any claim relating to the Services shall not exceed the amount you paid for the specific Service in the 30 days preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hosted-Tech and its owners, employees, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Services.
  • Your violation of these Terms or any applicable laws.
  • Any content or data you host, transmit, or process using the Services.
  • Any third-party claims arising from your actions or omissions.

14. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the collection and use of information as described in the Privacy Policy.

15. Third-Party Services

Some aspects of the Services may rely on third-party providers (such as data centers, carriers, VoIP providers, hardware vendors, or software vendors). We are not responsible for the acts, omissions, or failures of these third parties, and availability or performance of certain features may be affected by such parties.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of [Insert Your State], without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in [Insert Your County and State] for the resolution of any disputes.

17. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Services after changes to the Terms have been posted constitutes your acceptance of the revised Terms.
